Only 1,300 H-1B Slots Left!

The latest numbers released by USCIS indicate that the Fiscal Year 2010 H-1B Quota is close to getting capped.
As of November 20, 2009, a total of 56,900 petitions have been filed against the general quota. Assuming that the USCIS will stop accepting petitions after the limit of 58,200 is reached (i.e., 65,000 minus 6,800 reserved for Singapore and Chile), the quota cap is just short of 1,300.
It may be recalled that USCIS had received 42,000 petitions during the initial filing “window” of the first five business days in April 2009. Then it took about six months for the number to hit 46,700, which happened on September 25. However, the next one month period saw the filing of 6,100 petitions; and the subsequent five-day period saw an additional 1,000 filings! Then the next three weeks saw the numbers pop by another 3,100 petitions filed.
So now it is anybody’s guess as to how long it would take for the USCIS to get just 1,300 more petitions.
Once the quota is capped, the petitioners will need to wait for April 1, 2010 to file under the Fiscal Year 2011 quota, and the employment could start only on October 1, 2010.
