H-1B Count: The Suspense Continues

As of December 11, 2009, USCIS has received 62,900 H-1B cap-subject petitions, and, “until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact some of these petitions may be denied, revoked, or withdrawn,” petitions will continue to be accepted. USCIS has not indicated the cut-off point where it will stop accepting the petitions. The current number is far in excess of the general quota cap of 58,200 (after allowing 6,800 slots for Singapore and Chile from the total of 65,000). The Singapore/Chile quota was underutilized in recent years, and the expectation is that the demand would be around 1,000 this year. So that means, about 64,000 visas will be available for the general category. Now, how long will the USCIS keep accepting petitions after reaching the 64,000 or 65,000 mark to allow for denied, revoked, or withdrawn petitions? The suspense continues!
