Hello All, I am on bench for the last three months. Now my employer wants me to sign a leave notice. If not, he said he will revoke my H1b. I am not getting paid. I am confused. I don’t know what to do. Somebody please advice me how to handle this situation.

Hi Shalini, Not to worry. The employer can not force you to sign a fake leave of absence. The employer has a legal obligation to pay you on bench. When you are on H1b and not getting paid, you lose your legal status ( It does not matter if you are on bench or not). In order to get back your status you need to get back all your outstanding wages or file a complaint to the DOL using form WH4. The employer is trying to scare you. If the employer cancels the H1b, it is very difficult for him to get approval for H1B in future. Good luck
