I came to U.S on October 2007 and was working under H1B category. I got laid off last month. My previous employer has informed me that they sent the letter to INS to revoke my H1B petition. At the same time I am trying to find a new employer. Could you please tell me , how long does it take to revoke the H1B petition. What happens if I find another employer ? Please reply ASAP. Thank you.

The revocation of the H1B petition may not appear in the INS system for several months. Sometime it takes a long time. Although INS recognizes that a lot of H-1B employees are faced with layoffs and uncertainty about their immigration status, so far, it has not taken any steps to clarify this very unsettled area of the law. One should therefore make efforts to find another job as soon as possible and have the new employer sponsor the H1B employee for the H1B petition at the earliest opportunity. It is better to use “Premium processing” at the applicable service center. One may encounter problems without the availability of current pay stubs as proof of continuing, to keep valid H1B status.(Please correct me if I am wrong, I am not a legal person).
