| To put it in simple terms, H-1B visa is a non-immigrant visa issued for a temporary period while "Green Card" is for permanent residence in the U.S. So when an employer processes employment-based permanent residence ("Green Card") on behalf of a foreign national, the expectation is that the employer has a full-time, permanent job for the foreign national. However, the start of this employment will happen some time in the future, i.e., when the foreign national gets the "Green Card". In other words, the foreign national being in the U.S. on a part-time H-1B does NOT affect his/her ability to get a "Green Card" eventually. Hope this is clear. |
