Mistake in H1 application-2010 cap

My employer has filed the I-129 application subject to the 2010 cap. Unfortunately he made a mistake in the application ,that is, instead of writing 1st October as the job start date, he put it as 1st August. The application got rejected on April 29th saying “CIS received sufficient numbers of H1B petitions to reach the numerical limitation for fiscal year 2009”.(Reject letter –incorrect start date reject).Could you please advice me what to do next, can I send an apology letter explaining the clerical mistake, or can I file a new application. Thank you.

My friend, Do not wait anymore, file a new H-1B, by doing so at least you will not miss out this year quota. Good luck.
