Not sure why my previous posting not approved by admin Hi Guys, Its a great forum and somany topics are being discussed here.I started reading this since couple of days. Just wanted to understand what is legal for filing H1b from employee perspective 1) Is it legal to accpet the bank guarantee in the name of protecting the interests of the consultancy/company, which would be spending a considerable time and money ? ( like LCA,visa filing, attorney fees, flight fare, accomodation and local travel costs for one week on arrival ) 2) Invoking the BG ( bank guarantee ) if he leaves the company within 12 months from the date of joinig the company? 3) Is it legal to have such kind of agreements between employer and employee ? 4) What if the employee signed on a document with such agreements and left the company before 12 months. In my case it was just short of 13 days, its my bad. i didnt give attention to that 5) My employer deducted flight charges, accomodation and even the taxi charges from my last pay stub and paid the remaining amount saying that this is as per the our agreement that i signed on. Is it legal to have such agreements. Now my ex-employer is not sending release letter and bank guarantee to me. Need some experts advice on whether to give up the deductions he made ( filgith, accomodation etc ) or can i proceed legally. remember i signed on such agreement. Thanks much for your prompt response. If any one has official web site references, that would be great .Manoj
